Canadian Federal Skilled Worker Immigration program changes effective 26th June 2010

June 27, 2010

Today, Minister Jason Kenney announced the long-awaited updated list of occupations for the Federal Skilled Worker program of Canadian Immigration.

Canada’s 2010 quota for immigration is about  265,000 immigrants. The focus is on economic immigration to help the ease shortage of work force and boost the economy. And, Canadian immigration wants to reduce the backlog of older, already filed in process applications of Federal Skilled Worker (FSW) so they have gone ahead and reduced the number of eligible occupations so that they can finalise the pending applications and reduce the backlog.

This is indeed good news for all those people who have been in the pipeline for some years now. Soon they will have some update on their pending applications. But what about the rest of us, who were thinking of immigrating to Canada. Currently there are about 380,000 pending FSW applications down from 640,000 in Nov 2008.

Now what? There are 29 eligible occupations effective today, 26th June 2010 that are eligible to apply for FSW or have a job offer. The main purpose is to reduce the number of new applications. To achieve that goal they will only be taking a fixed amount of applications per eligible occupation for the year. So it will become a first come first serve FSW program. This will bring Canadian economic immigration program (federal skilled worker program) in line with the rest of the world, namely UK, Australia and New Zealand.

Wait for our next post with the list of the new in-demand occupations or eligible occupations and what is the new cutoff number of applications per year introduced today by the Canadian authorities.

Canada introduces “The Cracking Down on Crooked Consultants Act”

June 24, 2010

Citizenship, Immigration and Multiculturalism minister Jason Kenney, introduced legislation in the Canadian House of Commons to crack down on crooked consultants who exploit prospective immigrants.

“While most immigration consultants working in Canada are legitimate and ethical, it is clear that immigration fraud remains a widespread threat to the integrity of Canada’s immigration system,” said Minister Kenney. “The Cracking Down on Crooked Consultants Act will better protect prospective immigrants from crooked consultants and help safeguard our immigration system against fraud and abuse.”

Once the act becomes the law it will be a crime for unauthorised individuals to charge a fee for providing immigration services. It would also give power to the government to designate a body that would enforce and regulate immigration consultants and establish measures to enhance the government’s oversight of this body.

“Crooked immigration consultants victimize people who dream of immigrating to Canada,” said Minister Kenney. “Worse still, there is evidence that these individuals encourage prospective immigrants to lie on their immigration applications, to concoct bogus stories about persecution when making refugee claims, or to enter into sham marriages with Canadian citizens and permanent residents. This undermines the integrity and fairness of Canada’s immigration system.”

Minister also mentioned that  Citizenship and Immigration Canada will announce setting up of a transparent public selection process to identify a governing body to regulate immigration consultants in an attempt to gain public confidence.

Canada to review its immigration policy on inadmissibility of foreigners

June 19, 2010

The Canadian government vowed to review its immigration rules after Canadian visa officers in India barred dozens of people stating grounds that their service in army, police and intelligence units rendered them involved in human-rights violations.

Canada’s immigration law bars anyone from entering Canada, whether on a permanent residency or a visit visa if the person has carried out war crimes or has been involved in terrorism, systematic or gross human rights violation or genocide.

These refusals caused a huge furor in India and the Canadian Immigration Minister, Jason Kenney, apologized for the incorrect refusals of the applications. Clearly stating that the visa officers should never have cast aspersions on India’s institutions. He also said “Government of Canada therefore deeply regrets the recent incident in which letters drafted by public service officials during routine visa refusals to Indian nationals cast false aspersions on the legitimacy of work carried out by Indian defence and security institutions, which operate under the framework of democracy and the rule of law”.

He also pledged that Canada will review its policy on declaring foreigners inadmissible.
